Types of Applications

In New Zealand We Have the following Types of Design Applications:

– National Application | Filing Requirements |

– National Application Claiming Convention Priority from a Foreign Application | Filing Requirements |


Minimum Filing Requirements

The following information and documents are the minimum items that we require in order for us to prepare and file the relevant Design application.


National Application

Applicants Details

The full legal name and address of each person, company or other legal entity in whose name the application is to be made.


In the case of an applicant that is a foreign legal entity we will require the name of the country and or the state under whose laws the legal entity was created by incorporation or other.


Design Details

The title of the article to which the design is applied to.


The features of the design which are considered to be new and distinctive and particularly important when considering issues of validity and infringement.


Drawings or Photographs of the Design

The drawings or photographs must illustrate all the features that form the design and preferably the drawings or photographs are provided in digital file format such as a PDF, JPEG or DWG to facilitate reproduction, manipulation and electronic filing.


Drawings preferably must:

– be of drafting quality or no less than high quality artistic sketches of clear and definite detail;

– include sufficient views to illustrate each feature forming part of the design including a least one perspective;

– include a label for each view either individually, eg “ top perspective” or collectively, eg “full details (all views including perspective)”;

– be free of dimensions, or wording or trade mark material not being part of the design itself;

– be free of hidden detail;

– be free of drawing title blocks or borders.

– if the drawings are not provided in digital format they must be presented on a4 white paper and have a border margin of at least 25 mm around the a4 page free of the drawings or drawing label around the page and be presented in black ink or computer print. equivalent


Photographs preferably must:

– be clear originals and not photocopies;

– be a permanent image and not fade over time;

– include sufficient views to illustrate each feature forming part of the design including a least one perspective;

– include a label for each view either individually, eg “ top perspective” or collectively, eg “full details (all views including perspective)”;

– if the photographs are not provided in digital format they must be mounted on a4 white paper with suitable labels and have a border margin of at least 25 mm around the a4 page free of the photographs or label.


Authorisation of Agent

An authorisation of agent form is not required in order to complete a filing.


An authorisation of agent form is required, if an agent is appointed after filing the application or in cases when there is a change agent after filing the application.


National Application Claiming Priority from a Foreign Application

The same requirements as detailed for a National Application as provided above.


Time Limits

The time limit to file the application and claim priority from a corresponding eligible foreign application is +6 months from filing date of the first corresponding eligible foreign application.


Foreign Priority Details

The filing date, application number, and country where the foreign application was filed.


Authorisation of Agent

An authorisation of agent form is not required in order to complete a filing.


An authorisation of agent form is required, if an agent is appointed after filing the application or in cases when there is a change agent after filing the application.
